Pension thief, Yusufu, to know fate on new charges on June 20
The former director of the Police Pension Office, John Yusufu, it can be recalled was being prosecuted by the Economic and Financial Crimes Commission, EFCC, for allegedly concealing his interest in
SY-A Global Company Limited; and non-declaration of a sum of N250 million deposited in a bank account which were not contained in his asset declaration form.
However, the recent Federal High Court presiding Judge in charge of the case, Adamu Bello will on June 20, rule on the application by Mr. Yusufu, seeking to quash the four count charge preferred against him by the Economic and Financial Crimes Commission, EFCC
Mr. Yusuf is requesting that the court throw out the charge since it is similar to the one previously tried and convicted by another judge, Mohammed Talba, of the Federal Capital Territory High Court on January 28, 2013.
At the hearing on Thursday, the accused counsel, T. B. Maiyaki told the court he had earlier filed an application supported by a 17 paragraph affidavit, requesting that the charge against his client be quashed on the grounds that he had been tried and convicted on similar charge.
However, the prosecution counsel, Rotimi Jacobs, on the contrary requested the court dismiss the application for lack of merit saying it was intended to mislead the court and that the present charge does not amount to double jeopardy.
"They are quite different... section 309 of the Penal Code borders on criminal misappropriation, while section 27(3) of the EFCC Establishment Act which the current charge is hinged, borders on failure to disclose asset. Mr. Yusufu and six other top officials of the Police Pension Office were arraigned by the EFCC on March 29, 2012, on 16-count criminal charge bordering on conspiracy and criminal breach of trust. The other accused persons include: Esai Dangabar, Atiku Abubakar Kigo, Ahmed Inuwa Wada, Veronica Ulonma Onyegbula and Sani Habila Zira.
